Hireloop — Terms of Service
Last updated: 11 September 2026
These Terms of Service govern the supply of Hireloop’s recruitment screening services to business customers.
By purchasing a Hireloop search, the customer agrees to these Terms of Service.
1. Contract and eligibility
These Terms form a contract between:
Eclettica S.r.l.s.
Via Monastir 64/D
Torino (TO), Italy
VAT number: 13195790012
and the business or organisation purchasing a Hireloop search (the Customer).
Hireloop’s services are intended for business customers acting in connection with their business activities.
The contract is formed when Hireloop confirms that the Customer’s payment has been successfully processed.
The Terms in force at the time payment is successfully completed apply to that search.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, restricted or modified under applicable law, including the Australian Consumer Law where applicable.
2. The Hireloop service
For each search purchased, Hireloop provides the following services:
Job advertisement
Hireloop prepares:
- job advertisement copy based on the Customer’s brief; and
- a hero image for the advertisement.
Publication
Hireloop publishes the advertisement to the recruitment channels connected to the relevant Hireloop service for 30 days.
Publication depends on the availability and technical operation of third-party recruitment platforms and channels.
Applications
Applications received through the designated application address and correctly identifying the relevant search number are collected and processed as part of the search.
Candidate assessment
Hireloop assesses applications received during the collection period using its automated recruitment screening system.
The system assesses candidates against the requirements provided by the Customer.
Shortlists
Hireloop provides the Customer with a shortlist containing selected candidates and a reason for each selection.
Shortlists are delivered weekly during the collection period, for a total of four deliveries.
Assessment records relating to the search are retained for 12 months and remain available to the Customer during that period, subject to applicable law.
3. Services not included
Hireloop’s service ends with the delivery of the final shortlist.
Unless separately agreed in writing, the service does not include:
- interviews;
- interview scheduling;
- reference checks;
- background checks;
- verification of qualifications or employment history;
- employment contract preparation;
- salary or offer negotiation;
- employment advice;
- onboarding; or
- any other activity occurring after the shortlist has been delivered.
The Customer is solely responsible for deciding whether, how and when to contact or hire any candidate.
4. No guarantee of hiring outcome
Hireloop does not guarantee:
- that the Customer will hire a candidate;
- that any candidate will accept an offer;
- that any candidate will remain employed;
- that any particular candidate will be suitable for the Customer;
- that a particular number of applications will be received; or
- that any particular recruitment outcome will be achieved.
The only quantitative service commitment made by Hireloop is the refund commitment described in clause 6.
5. Price and payment
The price for one Hireloop search is:
A$1,490 + GST
Payment is required in full before the relevant search begins.
Nothing in the service will commence until payment has been successfully confirmed.
Payment processing is handled through Stripe or another payment provider made available by Hireloop.
The Customer’s payment card details are processed by the relevant payment provider and are not stored directly by Hireloop unless expressly stated otherwise.
An invoice is issued at the time of payment.
Republishing the same brief
If the Customer republishes the same recruitment brief within 60 days of the original search, the price is:
A$690 + GST
Hireloop may determine whether a subsequent search constitutes the same brief for the purposes of this discounted price.
6. Refund guarantee
If fewer than 10 eligible applications are received within 30 days from the date the job advertisement is published, Hireloop will refund the full amount paid for the relevant search, including GST.
The refund is the Customer’s sole quantitative service guarantee, subject to the terms of this clause.
6.1 Eligible application
An application is an Eligible Application only if all of the following conditions are satisfied:
- the application was received at the designated application address;
- the application correctly identifies the relevant search number;
- the application was received within the 30-day publication period;
- the application contains a machine-readable CV or résumé;
- the candidate satisfies all mandatory requirements specified by the Customer before publication;
- the candidate satisfies the minimum experience requirement specified by the Customer, subject to a tolerance of nine months; and
- the application does not fall within an exclusion expressly specified by the Customer before publication.
Hireloop’s system records constitute the primary record for determining the number of applications received and the reasons applications were excluded.
The Customer may inspect the relevant records and the recorded reason for each exclusion.
6.2 Requesting a refund
A refund request must be submitted within 14 days after the end of the 30-day application period.
Approved refunds will be paid within 14 days after the refund request has been accepted.
6.3 Circumstances in which the refund does not apply
The refund does not apply where:
- the Customer closes the search before the end of the 30-day period;
- the Customer changes the role requirements after publication;
- the Customer materially changes the recruitment brief after publication;
- the Customer provides requirements that make the minimum number of Eligible Applications objectively unreachable; or
- Hireloop identified and notified the Customer before publication that the specified requirements were excessively restrictive or otherwise likely to prevent the refund threshold from being reached, and the Customer nevertheless proceeded.
7. Customer responsibilities
The Customer represents and warrants that:
The position is genuine
The advertised position is genuine and the information supplied to Hireloop is accurate and not misleading.
The Customer is responsible for ensuring that the advertisement accurately describes the position, including remuneration, employment conditions and other material terms.
Authority
The Customer has the authority to advertise the relevant position on behalf of the named business or organisation.
Lawful recruitment criteria
The Customer’s requirements, selection criteria and instructions are lawful and do not unlawfully discriminate against prospective employees.
The Customer must comply with applicable Australian anti-discrimination and employment laws, including the Fair Work Act 2009 (Cth) and applicable federal and State or Territory anti-discrimination legislation.
Australian workplace protections prohibit adverse action against prospective employees on a range of protected grounds, including race, sex, age, disability, pregnancy, religion, sexual orientation, gender identity and other protected attributes. (Fair Work Ombudsman)
Candidate information
The Customer must handle candidate personal information lawfully and only for legitimate recruitment and selection purposes.
The Customer is responsible for complying with privacy obligations that apply to its own handling of candidate information after receiving it from Hireloop.
Right to refuse or stop a search
Hireloop may refuse to publish or may suspend or terminate a search where Hireloop reasonably believes that the search:
- is misleading or deceptive;
- contains unlawful or discriminatory requirements;
- may expose Hireloop or another party to legal or regulatory risk;
- is being used for an unlawful purpose; or
- materially conflicts with these Terms.
Where Hireloop refuses or stops a search for these reasons before the service has been substantially performed, Hireloop may provide a full refund of the amount paid, subject to applicable law.
8. Automated screening and artificial intelligence
Hireloop uses automated technology and artificial intelligence to assist with candidate screening, assessment and ranking.
The Customer acknowledges that:
- Hireloop’s assessment is a recruitment-support tool;
- the assessment does not replace the Customer’s own decision-making;
- the Customer remains responsible for deciding whether to contact, interview or employ a candidate;
- the Customer must independently assess candidates before making an employment decision;
- candidates may have rights to request human review or information about automated assessment under applicable privacy laws;
- Hireloop does not make the final employment decision on behalf of the Customer; and
- the Customer must not rely solely on Hireloop’s assessment when making a hiring decision.
Hireloop’s automated assessment may assist in identifying candidates against the criteria supplied by the Customer, but it does not constitute a guarantee that a candidate is suitable for employment.
9. No candidate communication without Customer action
Hireloop does not send employment offers, rejection notices or other hiring decisions to candidates on behalf of the Customer unless expressly agreed otherwise in writing.
The Customer remains responsible for deciding whether and how to communicate with candidates.
The Customer is responsible for ensuring that any communication it sends to candidates complies with applicable law.
10. Intellectual property and content ownership
The Customer retains ownership of:
- its recruitment brief;
- information supplied by the Customer;
- notes supplied by the Customer; and
- other Customer-provided materials.
Hireloop retains all rights, title and interest in:
- the Hireloop software;
- the Hireloop platform;
- algorithms;
- screening methodologies;
- scoring models;
- AI systems;
- databases and system architecture;
- workflows;
- proprietary technology; and
- other intellectual property belonging to Hireloop.
Advertisement content
Hireloop grants the Customer a perpetual, non-exclusive, royalty-free licence to use the job advertisement copy and hero image produced for the Customer’s search.
The Customer may use, reproduce, modify, publish and display that content for its own recruitment and business purposes.
The licence does not transfer ownership of Hireloop’s underlying software, systems, methodologies or intellectual property.
11. Third-party platforms and recruitment channels
Hireloop may rely on third-party recruitment websites, job boards, hosting providers, communication services and other external platforms.
Hireloop does not control the availability, functionality, algorithms, policies or performance of third-party platforms.
Accordingly, Hireloop does not guarantee:
- uninterrupted availability of a third-party platform;
- a particular position in search results;
- a particular number of views;
- a particular number of applications from any individual channel; or
- the continued availability of any particular recruitment channel.
However, if the job advertisement is not successfully published on any connected recruitment channel at all, Hireloop will provide a full refund for the affected search.
12. Liability
To the maximum extent permitted by applicable law, Hireloop will not be liable for:
- loss of profit;
- loss of revenue;
- loss of business opportunity;
- loss of anticipated savings;
- loss arising from the Customer’s hiring decision;
- loss arising from the conduct or performance of a candidate;
- indirect or consequential loss; or
- failures or interruptions caused by third-party recruitment platforms.
Subject to the remainder of this clause, Hireloop’s aggregate liability arising out of or in connection with a particular search is limited to the amount actually paid by the Customer for that search.
This limitation does not apply to the extent that liability cannot lawfully be excluded or limited.
Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under applicable law, including the Australian Consumer Law where it applies.
Where the Australian Consumer Law permits a limitation of liability for services, Hireloop’s liability may be limited, at its option, to supplying the services again or paying the cost of having the services supplied again, to the extent permitted by law.
Nothing in these Terms excludes or limits liability for:
- fraud or wilful misconduct;
- death or personal injury caused by negligence;
- liability that cannot lawfully be excluded or limited; or
- any other liability that applicable law prohibits the parties from excluding or limiting.
13. Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict or modify the operation of the Australian Consumer Law, including any consumer guarantees that apply to the services.
Where the Australian Consumer Law applies, the Customer has rights and remedies that cannot be excluded by contract.
For business purchases, Australian Consumer Law protections can apply in certain circumstances, including where the relevant service costs less than A$100,000 including GST or where other statutory criteria are satisfied. (ACCC)
To the extent permitted by law, the parties acknowledge that these Terms are intended to operate consistently with the Australian Consumer Law.
If any provision of these Terms is inconsistent with a mandatory provision of the Australian Consumer Law, that mandatory provision prevails to the extent of the inconsistency.
14. Term and completion
A search begins once payment has been successfully confirmed and the advertisement is ready for publication.
Unless terminated earlier in accordance with these Terms, the search ends when:
- the final shortlist has been delivered; or
- the 30-day application period has ended,
whichever occurs later in the ordinary operation of the service.
The Customer may close a search early at any time.
Closing a search early does not, by itself, entitle the Customer to a refund.
This does not affect any statutory rights or remedies available to the Customer under applicable law.
15. Suspension and termination by Hireloop
Hireloop may suspend or terminate a search where:
- the Customer breaches these Terms;
- the Customer provides materially misleading information;
- the search contains unlawful or discriminatory requirements;
- the Customer uses the service for an unlawful purpose;
- continued performance would expose Hireloop to material legal or regulatory risk; or
- the Customer fails to make a required payment.
Where termination occurs because of the Customer’s breach, no refund will be due except where required by applicable law.
Where Hireloop terminates a search for reasons unrelated to the Customer’s breach and before the contracted service has been substantially performed, Hireloop will provide an appropriate refund for the undelivered portion of the service, subject to applicable law.
16. Confidentiality
Each party must keep confidential information received from the other party confidential and must not disclose it except:
- to employees, contractors or professional advisers who need the information;
- where disclosure is required by law;
- where disclosure is necessary to provide the services; or
- with the other party’s consent.
This obligation does not apply to information that is already public through no breach of these Terms or that was lawfully known to the receiving party before disclosure.
17. Privacy
The Customer acknowledges that candidate information is handled in accordance with Hireloop’s Privacy Policy.
The Customer must comply with all privacy obligations applicable to its own collection, use, storage and disclosure of candidate information.
Where the Customer receives candidate information from Hireloop, the Customer is responsible for handling that information in accordance with applicable privacy law and its own legal obligations.
18. Changes to the Terms
Hireloop may update these Terms from time to time.
The Terms applicable to a particular search are the Terms in force when payment for that search is successfully completed.
Changes will not retrospectively alter the contractual terms applying to a search that has already been purchased, except where required by law.
19. Severability
If any provision of these Terms is found to be invalid, void or unenforceable, that provision will be read down or severed to the extent necessary, and the remaining provisions will continue to operate.
Nothing in this clause affects the operation of any mandatory provision of applicable law.
20. Entire agreement
These Terms, together with the applicable order, payment confirmation and any written terms expressly agreed between Hireloop and the Customer, constitute the agreement between the parties concerning the relevant Hireloop search.
They supersede any previous discussions or representations concerning that search, except to the extent expressly incorporated into the agreement.
21. Governing law and jurisdiction
These Terms are governed by the laws of Australia.
The parties submit to the exclusive jurisdiction of the courts of New South Wales, Australia, and courts competent to hear appeals from those courts.
However, nothing in this clause prevents a party from exercising any non-excludable right or remedy available under applicable Australian law.
